1. Acceptance of Terms

By accessing or using CertiG33k (the “Service”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you may not access or use the Service.

2. The Service

CertiG33k provides training content and tools intended to support your preparation for technical certifications through hands-on practice and study workflows. We do not represent or guarantee exam outcomes, job placement, or specific performance results. CertiG33k is not affiliated with, sponsored by, or endorsed by any certification owners or cloud providers (including, without limitation, AWS, Microsoft Azure, Google Cloud, CNCF/Kubernetes, or CompTIA). All third-party names and marks are used for identification only and remain the property of their respective owners.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Accounts and Security

• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• You must notify us promptly of any suspected unauthorized use, compromise, or other security incident.

5. Minimal Data Model

The Service is designed to operate with minimal personal data. We collect only: (i) an account identifier associated with your email to authenticate and manage entitlements; and (ii) crash/diagnostic data necessary to troubleshoot reliability. Purchases and subscriptions are processed by Apple App Store and/or Google Play and are managed in-app through RevenueCat. We do not store full payment card or bank details.

6. Subscriptions, Billing, and Refunds

• App Stores Govern: Purchases, billing, renewals, cancellations, and refunds are handled by Apple App Store and/or Google Play under their respective terms and policies. RevenueCat is used to manage entitlements inside the app.
• No Direct Card Storage: We do not receive or store full payment card or bank details.
• Plan Changes: Upgrades, downgrades, cancellations, and refund requests must be managed through the same store where the subscription was purchased.

7. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, educational purposes. You may not: (a) resell, sublicense, or commercially exploit the Service or its content; (b) copy, scrape, modify, or distribute content except as permitted by law; (c) reverse engineer, decompile, or attempt to extract source code; (d) interfere with or attempt to circumvent any security or access control; or (e) use the Service in violation of applicable laws or the rights of others.

8. Intellectual Property

All content, features, and functionality of the Service (including questions, modules, UI, software, logos, and graphics) are the property of CertiG33k and its licensors, protected by copyright, trademark, and other laws. Third-party marks (e.g., AWS, Azure, Kubernetes) are used solely for identification and remain the property of their respective owners; no affiliation or endorsement is implied.

9. Account Deletion

You may delete your account from within the application at any time. Upon deletion, we remove your account-level personal data from our systems. App Stores and RevenueCat maintain their own records under their respective policies. We may retain a de-identified internal Database document ID solely for entitlement reconciliation, chargebacks, fraud prevention, or audit, which is not meaningful on its own.

10. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when feasible. We strive for reliability but do not guarantee uninterrupted, timely, secure, or error-free operation.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your expectations or guarantee exam results.

12. Limitation of Liability

To the maximum extent permitted by law, CertiG33k and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of—or inability to use—the Service, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless CertiG33k and its affiliates from any claim, liability, damage, loss, and expense (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms, your misuse of the Service, or your violation of any law or third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Mexico, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the courts located in Mexico City, Mexico. Where required by law, you and we will act in good faith to attempt informal resolution before filing any claim.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notice or email when feasible. Your continued use of the Service after such changes become effective constitutes acceptance of the updated Terms.
